The plain language of the agreement clearly limits the sale of City water to serve only defined commercial uses in a very specific area shown and described on the attached tax and zoning maps.
It seems outside reason and common sense that anyone - but especially a municipal attorney - could conclude otherwise. How the current city attorney could recommend to a siting commissioner of public works to do anything other than seek an amendment to the original contract suggests either incompetence or maleficence.
Let us hope that the city attorney's "opinion" presented to public works last year was not contrived to avoid a public discussion and vote on the matter, but his "opinion" is not credible and seems contrived to justify the action.
Even if there was a doubt in his mind, and how could there not have been, he should have proceeded on the side of caution.
Finally, we ask if the mayor was privy to the "opinion." Is it conceivable that as the appointing official under whose jurisdiction the city attorney serves did not see the opinion?
