Calling all candidates!

Saratoga Springs
April 9th, 2013


Charles Brown, Chair of the Saratoga Springs Democratic Committee, announced today that the nominations subcommittee will soon begin considering potential candidates for City and County public office endorsements. The subcommittee will be scheduling interviews for party endorsement for all offices, and those endorsed by the full committee will receive the complete support of the SSDC for 2013 November election.  All city residents who would like to be considered for endorsement by the party for these public offices should contact Mr. Brown by April 30th at charley.brown@saratogadems.org

I understand that the Rick wirth(less) and (dud) dudla team are running on the republican ticket for public safety again. I hope the people of our beloved city will not put the failed administration back in. Even the police and fire department would not back them.

The City Ethics Code prohibits private investigators from any role in the City Public Safety Department. I believe Wirth is a private investigator.

I know he was commissioner for one term, but I doubt that he and the then city attorney were even familiar with the Code.

This section of the City Code would create a problem for a Wirth candidacy. And why was he allowed to serve for 2 years without the Ethics Board dealing with the matter.

(c) Public safety. No public safety officer shall have any interest in or be employed in the City by any company, corporation, partnership, association or individual for the purpose of providing private investigations, accident reconstruction, fire prevention, or fire inspection or any other activity related to such public safety officer's employment with the City. This shall not be construed as prohibiting membership or service in volunteer fire or emergency medical organizations. Additionally, public safety officers may be employed in the City for the purpose of providing security or traffic services consistent with City policies.

3:32 - FYI - City code is outdated. Two issues you eluded to are not accurate.
A. Richard Wirth has not yet announced his intention nor committed to run for Public Safety position to date.
B.This issue was addressed in 12/29/09 article by Schenectady Gazette. It was deemed by Assistant District Attorney that the law states a Private Investigator can hold a Public Safety position as long as there is no conflict of interest with the position.For all pertinent information check Schenecatdy Gazette archives. Facts are important. TY

Assistant DA has NO jurisdiction here.

There are valid reasons why the prohibition is in the City Code. If there is a conflict with "the law" then the Ethics Board and the City Council need the info. If there is a valid conflict that renders the current Code "outdated" on this matter, then the Code must be amended.

Assistant DAs are first and foremost political people. Second, they have absolutely no powers to render legal opinions on such matters.

Only the State AG can do so.

It would seem more applicable to amend an outdated code than to address with the AG. If a candidate is well qualifified they should not be denied the opportunity to run for office. We have too many candidates not qualified for Council position that end up getting elected because of politics and the city suffers in many ways because of this.
